‘Glow and Handsome’ fairness cream will no longer be available: Court said – The name is similar to ‘Fair and Handsome’, it violates the rules of trademark.

Now no fairness product with the name ‘Glow and Handsome’ will be available. Because, the Calcutta High Court has ordered the company that manufactured it, Hindustan Unilever Limited (HUL), to remove it within a month. The court has given this decision due to violation of trademark rules. The case dates back to 2020, when HUL changed the name of its men’s fairness brand ‘Men’s Fair & Lovely’ to ‘Glow & Handsome’. This name was very similar to the fairness brand ‘Fair and Handsome’ of local FMCG company Emami. Emami had filed a case against HUL in 2020 alleging violation of his trademark rights. The court said – HUL misused the name of the famous brand. In its decision on the case, the court said, the name ‘Glow and Handsome’ is similar to Emami’s registered product ‘Fair and Handsome’, which is misleading. The court said- It is not right to use the important part of the name of a famous and leading product and keep the same name. By choosing the words ‘Glow and Handsome’, HUL has tried to take advantage of the branding of Emami’s product ‘Fair and Handsome’. There is a possibility of cheating in this. HUL said – ‘Handsome’ is a common word, it is used by everyone. In this case, HUL had countered Emami’s allegation by arguing that the word ‘handsome’ is a completely common word, which is also used by other competitors in the industry. . It is not used as a standalone mark. HUL had applied for the trademark for ‘Glow & Lovely’ in 2018. HUL had applied for the trademark for ‘Glow & Lovely’ with the Controller of Patents, Designs and Trade Marks under the Ministry of Commerce and Industry in 2018, but The controller had rejected him. More than 20 brands of Emami According to the company’s website, it has more than 20 brands and more than 450 products in more than 70 markets around the world. More than 3,200 employees work in the company. Emami’s turnover in FY 2023 was Rs 3460 crore. Emami was earning Rs 150 crore revenue annually. Emami had launched ‘Fair and Handsome’ in 2005. After its launch in 2005, ‘Fair & Handsome’ had 65% market share in this segment. The company was also earning an annual revenue of Rs 150 crore from this. By 2019-20 it had increased to more than Rs 2,430 crore.
