Three teachers were demoted for obtaining higher education without permission, High Court gave big relief to three teachers

It had proved costly for three primary teachers to pursue higher education without taking permission from their superiors. All three had not taken permission for graduation and post graduation degrees. As punishment, the promotion of all three was stopped, after which they approached the court. The issue is of Bhavnagar city of Gujarat. Now in this case, giving great relief to the three teachers, the court has ordered to lift the ban on their promotion.

This is the whole matter

Magan Dodiya, Savji Parmar and Haresh Rajguru served in the Municipal Board School in Bhavnagar city of Gujarat between 1980 and 1990. At that time, the required qualification for the post of primary teacher was only secondary schooling with a certificate course in primary teaching. After some time, the state government changed the rules and set standards for promotion. In such a situation, all three cleared the Head Teachers Aptitude Test (HTAT) required to become head teachers and were promoted during 2012.

Big shock in 2023

The year 2023 was very heavy for these three teachers. In fact, on December 8, 2023, the Bhavnagar Town Education Committee canceled the promotion of all three and demoted them to their actual post of Primary Teacher. All three were given this punishment for pursuing higher education without taking permission from the department.

All three knocked on the door of the court

After this all three approached the Gujarat High Court. Their lawyers told the court that the three teachers had sought permission to pursue higher studies, but the authority did not hear the applications of Dodiya and Parmar. In 1988, Rajguru was allowed to complete his graduation. At the same time, during 2010, he obtained a master’s degree. In such a situation, Rajguru was also punished.

The court gave this decision

The bench of Justice Nikhil Karel heard the case and ordered the three teachers Dodiya, Parmar and Rajguru to work as head teachers. The court has also issued a notice to the concerned authority in this matter.
